Class Action Suit vs Apple Under Way, 2nd Lawsuit In The Works    [ 01-07-2010 18:29 ]

Remember that class action lawsuit that was being prepared in California? Well another law firm has beat them to it, launching a suit in Maryland in the U.S.The lawsuit has been filed by Ward & Ward, PLLC, and Charles A. Gillman LLC on behalf of Kevin McCaffrey, Linda Wrinn and various other iPhone 4 customers. The complaint? What else could it be? The now infamous antenna issue of course! The suit makes various claims, which are listed below:

• General Negligence (APPLE and AT&T)
• Defect in Design, Manufacture, and Assembly (APPLE)
• Breach of Express Warranty (APPLE)
• Breach of Implied Warranty for Merchantability (APPLE and AT&T)
• Breach of Implied Warranty of Fitness for a Particular Purpose (APPLE and AT&T)
• Deceptive Trade Practices (APPLE and AT&T)
• Intentional Misrepresentation (APPLE and AT&T)
• Negligent Misrepresentation (APPLE and AT&T)
• Fraud by Concealment (APPLE and AT&T)

The antenna problems being reported by thousand sof customers are not confined to the U.S. of course, reports have surfaced in just about every country that the iPhone 4 is officially on sale in. Whether this means we will see more lawsuits appearing in other countries remains to be seen, but with two already in the U.S. it wouldn't be too surprising. You can see the full complaint here.

Microsoft to Allow Customers To Try Apps Before Buying    [ 01-07-2010 17:44 ]

Apple and Google have undeniably had huge success with their app store formats, each seeing tens of thousands of apps launched and hundreds of millions of downloads. There are of course various problems with each of those stores, some of their own making it has to be said, but one drawback that is inherent to both is the absence of any ability for customers to try out an app before they buy it. Sure a developer might create a free version of their app with reduced functionality to let people see what it's all about, but that's completely at the whim of the individual developer. Microsoft is looking to make things easier for both customers and developers though by giving devs the option of allowing customers to try out an app before parting with their hard earned cash. Is it a gimmick or a genuine attempt at enhancing the experience customers will have in Microsoft's Marketplace? Probably a bit of both if truth be told, after all Microsoft is going up against two very well established app stores, which just also happen to be the biggest app stores and they both have powerful corporate machinery behind them to back them up. Microsoft won't be doing themselves any harm in differentiating their own app store with a little sweetener like this.

Moto Joins Nokia: Gets In Shot At Apple    [ 01-07-2010 17:25 ]

Nokia had a bash at Apple the other day with a tongue-in-cheek guide on how to hold your phone and now Motorola has joined in on the Apple bashing fun. Motorola took out a full page advert in the New York Times to promote its Droid X handset. However, the advert, whilst talking up the Droid X of course, managed to get in a punch at the iPhone 4, which has been plagued with antenna issues, amongst other problems, since it was launched late last month. The blow Motorola scored was in the form of the following comment in the advert:

"It comes with a double antenna design. The kind that allows you to hold the phone any way you like and use it just about anywhere to make crystal clear calls."

It seems like it's open season on Apple these days, and with the seemingly never ending stream of antenna issues and lawsuits and email exchanges surrounding Cupertino Apple's competitors are having a field day with it. Check out the actual Motorola Droid X advert below:

Steve Jobs: "It is just a phone. Not worth it."    [ 01-07-2010 17:16 ]

There appears to be no end in sight to the iPhone 4 antenna saga with Steve Jobs once more leaping into the frey. It's a pretty simple story, a Boy Genius Report reader emailed El Jobso to complain about the antenna issue and he got a reply ... several in fact. What followed was a rather terse conversation, in which the reader made his feelings clear to Mr Jobs, and was told to calm down and relax. That didn't sit too well with the reader who was rather upset at Mr Jobs' cavalier attitude. Eventually the exchange ended with Steve Jobs uttering what might very well become an even more infamous remark than his earlier 'just hold it differently' comment, this time his advice was "It is just a phone. Not worth it." That's the 'magical', 'revolutionary' product that was unveiled at last month's keynote he's talking about by the way.

We've included the email exchange below with some commentary to keep you right as you read through it:

The first email sent to Jobs:

"[Apple engineer name redacted], When we spoke, you would not tell me that there is a fix for this phone?

A friend just sent me this: http://www.boygeniusreport.com/2010/06/29/leaked-apples-internal-iphone-4-antenna-troubleshooting-procedures/

I assume there is no fix then. If this is legit, I have lost all respect for apple and just want to go back to Verizon and get a nice Android phone. And don’t tell me they have the same issues, all our co-workers with Androids are just mocking us right now…. “Hey, I am going to go in the basement and continue my call. You can use my office on the 2nd floor so you can get a signal”. You are going to kill your brand over one product. Apple is coming off arrogant and rude. If there is no fix just tell people so they can return their phones. We have work to do. I have bought just about every apple product made in the last 20 years and this is the 1st time I am ashamed to be a MAC fan.

Jobs' reply:

"No, you are getting all worked up over a few days of rumors. Calm down."

The reader replies to Jobs:

"I am really insulted… “Calm down”…. “rumors”… What arrogance. This is will be marked as the begging of the end of Apple. Seriously, DO THE RIGHT THING. I just had dinner with 3 people who had iPhone 4s we all cant make calls without dropping. There is no rumors it is reality."

Jobs come down from the mountain to reply again:

"You are most likely in an area with very low signal strength."

The reader isn't too happy with that response and emails Jobs back again:


"Stop with jackass comments. I have has every iphone made. They all had a bad signal but this is the so much worse X3. The whole country is is in a “low signal strength” in reality… all but apple campus and your house it seems? AT&T maps are a joke. I am in “excellent” to “good” coverage and on my iPhone 1, Iphone 3G, and my iPhone 3Gs, I could at least make a telephone call. After all, it is a phone. Iphone 4…. 5 bars….. touch the phone… ZERO bars call drops.

Steve. IT DOES NOT WORK! Geezzz I hope this this is not really you. Are we on a different MHz? I have yet to see an iPhone [4] work in Richmond when you hold it in your hand. It is not “isolated”. I was a big fan. But I am done.
"

Jobs replies again:

"You may be working from bad data. Not your fault. Stay tuned. We are working on it.

Sent from my iPhone
"

Jobs then sends another reply even though the reader hasn't responded to his last email:

"Retire, relax, enjoy your family. It is just a phone. Not worth it."

Yahoo! Releases Apps For Android    [ 01-07-2010 15:31 ]

As the saying goes 'better late than never' and that seems to be Yahoo!'s approach to Android, releasing an app only now as they are. In fact there are two apps from Yahoo! in the marketplace, one for mail and a messenger app. Why two and not just one single consolidated app to make life easier a le the Windows Live iPhone app? Yahoo! is the only one that can answer that question. Actually, if you are in America you will have access to a third point of contact with Yahoo! in the form of a search widget similar to the standard Google search widget that is so familiar on Android handsets. The Yahoo! search widget even supports voice input just like its Google sibling. As before the search widget is only available in the U.S., but the other two apps are available worldwide. As you would expect the apps are all free and you will need to be running at least Android 2.0 to make use of them. It's not just Android users who are getting something for nothing though, iPhone users, perhaps in need of some good news for a change, are to benefit from a new HTML5 platform that Yahoo! is setting up.
